Moving in together in Toronto usually starts with a spreadsheet. Rent, hydro, internet, who pays the first month. Almost nobody runs the other version of the numbers: what this lease costs you if the relationship ends in month seven and one of you moves out.

The answer surprises people, because a lease does not care about the relationship at all.

Both names on the lease means both of you owe all of the rent

When two people sign the same tenancy agreement, they are joint tenants, and joint tenants are jointly and severally liable. In plain terms: the landlord can pursue either one of you for the entire rent, not half of it.

That “severally” is the part that bites. If your ex stops paying their share in September, the landlord does not have to chase them. The landlord can come after you for the full amount and let the two of you sort it out privately. From the building’s perspective there is one tenancy and one rent, and it is late.

Moving out does not take your name off the lease

Packing a truck is not a legal act. Handing back your keys is not either. Until the tenancy actually ends, or the landlord agrees in writing to remove you, you remain a tenant with all of a tenant’s obligations, whether or not you have slept in the unit since spring.

There are three real exits, and all of them require someone other than you to agree:

  • Assignment. Under the Residential Tenancies Act, 2006 you can ask the landlord to consent to assigning your interest in the tenancy to someone else. The landlord cannot unreasonably refuse. If they do refuse or simply do not respond, the Act gives the departing tenant the right to give notice to end their own tenancy.
  • A new lease. The cleanest option in practice. The remaining partner signs a fresh tenancy agreement in their name alone and the old one is ended. Landlords often prefer this because it lets them re-qualify the remaining tenant.
  • Ending the tenancy. A tenant can give proper notice to end a periodic tenancy. Be careful here: the Landlord and Tenant Board has generally treated a valid notice from one joint tenant as ending the tenancy for everyone in the unit, which means the partner who wanted to stay can find themselves without a home. That cuts both ways, and it is worth legal advice before anyone files a form.

If you are the one staying, act early

The partner who stays usually has the harder problem, because they need the landlord to agree to something. Landlords are far more receptive when the request arrives before anyone has missed a payment, and far less receptive after the first N4 notice has gone out. Ask in writing, offer to re-qualify on income, and get the outcome in writing too.

If you are the one leaving, do not rely on a verbal “you are off the lease”. Six months later, when rent is short, that conversation will not exist.

The deposit, the furniture, and the cat

The last month’s rent deposit belongs to the tenancy, not to whoever transferred the e-transfer. It gets applied to the final month or returned at the end. How the two of you split that between yourselves is a private matter, which is another way of saying it is an argument with no referee.

Furniture and pets are property questions. Ontario courts treat animals as property, so the answer usually turns on who bought, registered, insured and cared for the animal, not who loves it more. That is a cold way to describe a dog. It is also how the file gets decided.

The document that settles all of this in advance

None of the above is hard to sort out before you move in, and all of it is miserable to sort out afterwards. Under section 53 of the Family Law Act, two people who are living together or intend to live together can sign a cohabitation agreement setting out ownership and division of property and support obligations. That is where the boring answers live: who is on the lease and what happens if one of you leaves, whose furniture is whose, how a shared down payment or a parental gift is treated, who keeps the pet. People often work through this with a cohabitation agreement lawyer at the same time they are apartment hunting, because that is when the facts are fresh and neither person is angry.

For couples who later buy a place together in this market, the same agreement carries even more weight. Unmarried partners in Ontario do not get the automatic property equalization that married spouses do, so a written record of who contributed what is often the only evidence that exists.

Before you sign anything

Read the lease itself. Most residential tenancies in Ontario must use the Ontario Standard Lease, and the appendix is where landlords add the terms people skip. Confirm who is named as a tenant and who is only an occupant, because the difference decides who is on the hook. If a dispute does start, the Landlord and Tenant Board is the body that hears it.

Then have the awkward conversation once, in writing, while you still like each other. It takes an afternoon. The alternative takes months.
